1. Eligibility
The Apex Competitions BMW M550i Giveaway (the "Promotion") is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age at the time of entry. Employees of Apex Competitions LLC, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, and immediate family members and/or those living in the same household of each are not eligible to participate. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Promotion Period
The Promotion begins on the date published on the website and ends on the Draw Date as displayed on the homepage countdown timer. All entries must be received before the closing deadline to be eligible.
3. How to Enter — Purchase Method
During the Promotion Period, visit apexcompetitions.com and purchase any eligible merchandise item (keychain or hat). Each eligible item purchased earns one (1) competition entry. There is no limit to the number of entries a participant may earn through purchase. Entries are non-transferable. Proof of purchase may be required.
4. Alternative Method of Entry (AMOE) — Free Entry
NO PURCHASE NECESSARY. To enter without purchase, hand-print your full legal name, complete mailing address (no P.O. boxes), city, state, ZIP code, date of birth, and email address on a 3" x 5" card and mail it in a stamped envelope to: Apex Competitions LLC — BMW M550i Giveaway Entry, New York, NY 10001. One (1) free entry per outer envelope. Mechanically reproduced entries are not eligible. Sponsor is not responsible for lost, late, misdirected, or illegible mail. You may also submit your free entry via the online form below. Limit one (1) free entry per person per day via mail or online form.
5. Prize
One (1) Grand Prize: BMW M550i automobile as pictured on the website. Approximate Retail Value (ARV): varies based on current market value. No cash equivalent or substitution of prize is permitted, except at Sponsor's sole discretion. Prize is non-transferable. All federal, state, and local taxes on the prize are the sole responsibility of the winner. Winner may be required to provide a valid Social Security Number for tax reporting purposes.
6. Winner Selection & Notification
The potential winner will be selected by random drawing from all eligible entries received by the closing date. The drawing will be conducted by Apex Competitions LLC or its authorized representative. Odds of winning depend on the number of eligible entries received. The potential winner will be notified by email and/or phone within 5 business days of the drawing. The potential winner must respond within 7 days of notification. Failure to respond may result in disqualification and selection of an alternate winner.
7. General Conditions
Sponsor reserves the right to cancel, suspend, and/or modify the Promotion, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner.
8. Limitation of Liability
By entering, you agree to release and hold harmless Apex Competitions LLC and its respective parent, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Promotion, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize.
9. Disputes
Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New York, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages.
10. Winner List
For the name of the winner, available after the draw date, send a self-addressed, stamped envelope to: Apex Competitions LLC — Winner List, New York, NY 10001. Requests must be received within 60 days of the draw date.
